The Truth, If There Is Such A Thing, Is So Incredibly Difficult To Elicit. Specifically In Regard To Human Interaction. Lawyers For The State And The Defense Use This To Their Advantage.
I don't want to make too many comments on this video until I see your cell tower video. I will say I was expecting Thompson's response to Anne's alibi defense document because he is correct, right now. There was nothing really new in that alibi that proved anything other than driving around in an area that possibly had no cell service and not even any specific times mentioned. I think there is 1 of 2 things going on here with the defense. Either they don't have any GPS coordinates to prove where he was and at what time because she has asked for it in her Motion to Compel Discovery and they haven't turned it over or she does have it but doesn't want to disclose it yet because she thinks that the state may mess around with the timeline of the homicides. There's a 3rd option and that is that there is no GPS coordinates to prove where he's was between 4 am and 4:30 am or even a time that could prove that he couldn't have gotten to Moscow by the time they say he was there. I don't like option 3! I'm nit sure what kind of witnesses Thompson is referring to, but if he had any witnesses that could have proven that he was at the King Rd residence between 4 am and 4:30 am, I sincerely think that would have been in the PCA, unless they came forward later. I think he wants to know what she has or is asking for to prove his alibi with GPS coordinates. If it was from apps on his phone, she could get that herself. There was already a warrant issued for Strava. If that could prove it and the state hasn't turned it over, it seems to me that she could get the info from Strava without a warrant. Bryan can ask for his own app info. If it is something in we phone itself, shouldn't she have already asked for access to his phone? Is that something that the state hasn't turned over yet and part of her Motion to Compel Discovery? Is that why the state wants that hearing private? So the public doesn't get to know what they are withholding. That woukd seem to be an easy fix fir Anne. Just submit a new alibi defense answer to the prosecution's request they hers be denied. In it, state that you will be more than happy to provide the exact GPS coordinates between 4 am and 4:30 am just as soon as the prosecution turns over X, Y, Z so you can put that info into the record. That wouldn't be sealed and the public would know why she hasn't been able to include the proof that the state is asking for. I will say that if the defense can't prove with GPS exactly where he was and why he couldn't have been in Moscow during the time of the homicides, then Thompson is correct, he can't use an alibi defense. I believe there are GPS coordinates to prove where he was but I Don not understand why she didn't just state that in his alibi. There has to be a reason. Now, I'll wait to see your video on the cell towers before I comment any further. Right now, I have more questions than answers. I did find Thompson's mention of time needed for witnesses to counter his alibi very confusing.
Thompson requesting the “list of witnesses” at the crime is him attempting to lure out the exculpatory evidence allegedly obtained by Bitonti imo. Billy has likely been chomping at the bit all the while to get a read on when to expect BF’s statements.
